Terms of Use
By entering the Osteoforensics Program, you agree that you have read and agree to be bound by the Terms of Use outlined in this document.
You also agree that this document may be updated at any time, and that it is your responsibility to fully review the document before entering the Osteoforensics Program.
Please review these Terms carefully as they serve as an enforceable contract between You (“Client” or “You” or “you”) and Osteoforensics (“We” or “we” or “Us” or “us”) and contain important information about your legal rights, remedies, and obligations.
Program
Osteoforensics agrees to provide you with access to the asynchronous 100% Online educational resource entitled, “Introduction to Forensic Anthropology” (“Program”). It is designed in use for Independent Study (ELO/PBGR/Credit Flexibility/Credit for Proficiency/Flexible Pathway/CRLE). Osteoforensics provides curriculum, instructional media, and automated assessments but does not provide direct student supervision or legal academic credit.
The awarding of high school or elective credit is at the sole discretion of the student’s home school, school board, school district, Department of Education, or any of their representatives. Osteoforensics is not responsible if the student’s home school, school board, school district, Department of Education, or any of their representatives chooses not to award credit. A Highly Qualified Teacher, Maine Certified Teacher, Licensed Vermont Educator, Teacher of Record, Instructor of Record, ELO/PBGR/Credit Flexibility/Credit for Proficiency/Flexible Pathway/CRLE Coordinator, or Faculty member from the student’s school must serve as the Instructor/Teacher of Record to oversee progress and verify competencies based on the provided syllabus. Osteoforensics serves as a content and assessment resource only; all final grading, competency, verification, and credit awards remain the sole responsibility of the student’s school-appointed Instructor/Teacher of Record.
Osteoforensics does not make any commitment to you that you will obtain any particular result from your use of the Program or that you will obtain any particular qualification, credential, or employment on completion of the Program.
The curriculum contains images, case studies, and discussions involving human skeletal remains, decomposed human remains, and forensic science. By enrolling, the student and their parent or legal guardian acknowledge the nature of this subject matter. Osteoforensics is not liable for any distress or dissatisfaction arising from the presentation of these materials.
This Program requires anonymous enrolment. For high school students, a parent or legal guardian must register using school-assigned aliases or ID numbers. Osteoforensics does not require the submission of Personally Identifiable Information such as home addresses, dates of birth, or full legal names for students utilizing the Program through a school-approved ELO/PBGR/Credit Flexibility//Credit for Proficiency/Flexible Pathway/CRLE.
Enrolment is a manual process. Upon verification of payment, access will be granted within 24-48 hours. Access is tied to the username provided at the time of purchase and is non-transferable.
Osteoforensics provides the Program “as is” and is not liable for any technical interruptions, academic outcomes, or any indirect damages resulting from the use of the online platform.
As a condition of participating in the Program, you agree to be bound by and to abide by all policies and procedures set out in this Agreement, including those incorporated by reference.
Resource “Content” refers to any material presented in the Program, and accessed on the Osteoforensics MoodleCloud site, to facilitate learning, for example, but not limited to: syllabus, recorded lectures, visual and graphic material, written material, videos, websites, tests.
Who May Use Our Services
You need an account for participation in the Program.
You may only create an account in the Program only if you:
(a) can form a binding contract with Osteoforensics; and
(b) comply with these Terms of Use and Privacy Policy, all applicable laws, and our policies; and
(c) are over the age at which you can provide consent to data processing under the laws of your country.
If you do not satisfy the account creation requirements (as stated above), the parent or legal guardian is the legal Client and contracting party responsible for the purchase, opening the account, and oversight of the student’s participation. If we discover that you have created an account that violates these rules, we will terminate your account.
A parent or legal guardian must register for their child on Osteoforensics MoodleCloud. The parent or legal guardian must register a username using school-assigned aliases or ID numbers. This ensures the identity of the minor remains private on the learning platform.
When creating and maintaining your account, you must provide and continue to provide accurate and complete information, including a valid email address. You have complete responsibility for your account and everything that happens on your account, including for any harm or damage (to you or us or anyone else) caused by someone using your account without your permission. This means you need to be careful with your password. You may not transfer your account to someone else or use someone else’s account. If you contact us to request access to an account, we will not grant you such access unless you can provide us with the information that we need to prove you are the owner of that account. In the event of the death of a user, you must provide a death certificate to show the owner has died, and then the account of that user will be closed.
You may not share your account login credentials with anyone else. You are responsible for what happens with your account and Osteoforensics will not intervene in disputes between you or anyone else who have shared account login credentials. You must notify us immediately upon learning that someone else may be using your account without your permission (or if you suspect any other security incident) by contacting [email protected]. We may request some information from you to confirm that you are indeed the owner of your account.
Our License to You
Subject to these Terms and our Policies, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license right to use the Program for which you have paid all required fees. The rights granted herein are only for your personal, non-commercial use. You may not reproduce, redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, create derivative works of, sublicense, or otherwise transfer or use any content. You also agree that you will create, access, and/or use only one user account, unless expressly permitted by Osteoforensics, and you will not share access to your account or access information for your account with any third party. Participating in this Program does not give you ownership of or any intellectual property rights in the Program or the content you access.
You may not do any of the following while accessing or using Osteoforensics’ MoodleCloud Programs or social media sites:
(a) access, tamper with, or use non-public areas of the platform (including content storage), Osteoforensics’ computer systems, or the technical delivery systems of Osteoforensics’ service providers.
(b) disable, interfere with, or try to circumvent any of the features of the platforms related to security or probe, scan, or test the vulnerability of any of our systems.
(c) copy, modify, create a derivative work of, reverse engineer, reverse assemble, or otherwise attempt to discover any source code of or content on the Osteoforensics MoodleCloud site.
(d) access or search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our social media sites. You may not scrape, spider, use a robot, or use other automated means of any kind to access Osteoforensics’ services.
(e) in any way use Osteoforensics services to send altered, deceptive, or false source-identifying information (such as sending email communications falsely appearing as Osteoforensics); or interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on our services.
Commercial Use
Any use of our Program for commercial purposes is strictly prohibited.
Content Offerings
Osteoforensics reserves the right to cancel, interrupt, reschedule, or modify any Program, or change the point value or weight of any assignment, quiz, or other assessment.
Osteoforensics does not grant or guarantee academic credit for the completion of its Program.
Osteoforensics is not responsible for any content that you may find undesirable or objectionable. You understand that by using Osteoforensics you may be exposed to content that you may find offensive, indecent, incorrect, or objectionable, and you agree that under no circumstances will Osteoforensics be liable in any way for any content, including any errors or omissions in any content or any loss or damage of any kind incurred as a result of your use of any content. Osteoforensics disclaims any liability for unauthorized use or reproduction of any portion of the Program.
Through the Program, you will have the ability to access and/or use links to websites and services maintained by third parties. Osteoforensics cannot guarantee that such third party content, in the Program or elsewhere, will be free of material you may find objectionable or otherwise inappropriate or of malware or other contaminants that may harm your computer, mobile device, or any files therein. Osteoforensics disclaims any responsibility or liability related to your access or use of, or inability to access or use, such third party content.
When you use Osteoforensics, you will find links to other websites that we do not own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should also read their terms and conditions and privacy policies.
We may not be able to deliver the Program to certain regions or countries for various reasons, including due to applicable export control requirements or internet access limitations and restrictions from governments, or for commercial or reputational reasons. None of Osteoforensics, its contributors, sponsors, and other business partners, and their employees, contractors, and other agents shall have any liability to you for any such action.
Pricing and Payments
Osteoforensics offers an asynchronous 100% online non-credit educational resource. For you to access the educational resource you (or in cases of minors or school students, the parent or legal guardian) agree to pay the associated Program fee of $225 (Canadian Dollars) for 160 days access to the Program. The Program fees are quoted in Canadian currency and must be paid in Canadian currency. Access to the Program begins the day you are manually enroled in the Program (see “Access to the Program”).
The Program fee is payable with a one-off lump-sum payment. You, or in cases of minors or school students, the parent or legal guardian, are responsible for paying all fees charged by, or for, Osteoforensics and applicable taxes with a payment mechanism associated with the Program. Any currency conversion costs or other charges incurred in making a payment shall be borne by you, or your parent or legal guardian, and shall not be deductible from the amounts due to Osteoforensics.
You (or in cases of minors or school students, the parent or legal guardian) authorize us to charge your credit card through the Program payment processor for those fees. When you make a purchase, you agree not to use an invalid or unauthorized payment method. If your payment method fails and you still get access to the Program, you agree to pay us the corresponding fees within 3 calendar days of notification from us. We reserve the right to disable access to any Program for which we have not received full payment. Osteoforensics reserves the right to change any fees at any time at its sole discretion.
You (or in cases of minors or school students, the parent or legal guardian) may incur charges to your internet service provider while you are accessing the Program. You (or in cases of minors or school students, the parent or legal guardian) are responsible for paying any such charges.
If you are located in a country where use and sales tax, goods and services tax, or value added tax is applicable to consumer sales, we are responsible for collecting and remitting that tax to the proper tax authorities. Depending on your location, the price you see may include such taxes, or tax may be added at checkout.
Access to the Program
How to access the Osteoforensics MoodleCloud Program:
(a) You (or in cases of a minor or high school student, your parent or legal guardian) register for an account on Osteoforenics MoodleCloud,
(b) You (or in cases of a minor or high school student, your parent or legal guardian) sends a request for enrolment to [email protected], ensure all pre-filled fields are accurate,
(c) You (or in cases of a minor or high school student, your parent or legal guardian) will receive a secure payment link and must pay the Program fee in full,
(d) Osteoforensics will then manually enrol you in the Program for which you paid the full fee.
(e) Once you have been enroled in the Program, you will have 160 days access to the Program.
(f) When the enrolment term expires, your account will be deleted from the system within 30 days of the 160-day access window closing, or immediately upon written request from a parent or school official, unless a specific written request is made by the parent to retain the student’s records.
Osteoforensics will use reasonable endeavours to make the Program available but cannot guarantee uninterrupted, timely or error free availability or that defects will be corrected.
You also accept and acknowledge that Osteoforensics cannot be held responsible for any delay or disruptions to your access to the Program as a result of such suspension or any of the following:
(g) the operation of the internet and the world wide web, including but not limited to viruses;
(h) any firewall restrictions that have been placed on your network or the computer you are using to access the Program;
(i) failures of telecommunications links and equipment; or
(j) updated browser issues
Osteoforensics does not make any commitment that the Program will be compatible with or operate with your software or hardware.
You accept and acknowledge that periods of downtime may be required in respect of the information technology infrastructure connected to the MoodleCloud website or Google mail and that assistance may not be available during such periods of downtime. Further you accept that you will not have a claim for breach of contract or otherwise in respect of such period of unavailability.
Refund Policy
There is a strict no-refund policy for this Program. By registering, you acknowledge and accept that no refund will be issued for this Program.
Your Responsibilities
You are solely responsible for your behaviour while using the Osteoforensics Program. You are responsible for ensuring you have adequate internet connectivity and technical setup to use the Program. You may not record, reproduce, or share any part of the Program. You are also prohibited from sharing any content links, login information, or other access credentials with anyone else. You may not engage in any behaviour that is inappropriate, offensive, hateful, sexist, racist, pornographic, unlawful, or otherwise objectionable, share information that is false, misleading, defamatory, or invasive of another's privacy, or harass the instructor.
Osteoforensics may, in its reasonable discretion, and without liability or an obligation, refuse to supply any Program to any student who engages in inappropriate behaviour.
You agree to take full responsibility for any harm or damage you, or anyone else, suffer as a result of the use, or non-use, of the information available in the Program.
Ownership Of All Intellectual Property
All video lectures created by Dr. Tanya Peckmann included as part of the Program are the property of Osteoforensics and protected by copyright and other laws that protect intellectual property and proprietary rights.
The Osteoforensics name, logo, slogan, and all related names, logos, product and service names, designs, and slogans are trademarks of Osteoforensics. You must not use such marks without the prior written permission of Osteoforensics. Your participation in the Program does not result in a transfer of any intellectual property to you, and, as a condition of participation in the Program, you agree to observe and abide by all copyright and other intellectual property protection. You hereby agree that any infringement of Osteoforensics intellectual property shall result in an immediate termination of your access to the Program.
Disclaimer
The Program and its Content is for educational purposes only. Osteoforensics will not accept any responsibility to any party for the use of the Program or its Content for any purpose other than educational purposes, including but not limited to the giving of advice by you to any third party.
Dispute Resolution
You hereby expressly waive any and all claims you may have, now or in the future, arising out of or relating to the Program.
If you have a dispute with us, you must give us the opportunity to resolve the dispute informally through negotiation, with you and us acting in good faith, for no less than sixty (60) days after you provide written notice of the dispute.
In the event we are unable to resolve your complaint, either party may pursue a claim in binding arbitration in Halifax, Nova Scotia, Canada.

You agree that regardless of any law to the contrary (including any relevant statutes of limitation), any notice of dispute must be filed by you within 60 days after a claim or cause of action that you may have arising out of or related to use of our site or this agreement has accrued or be permanently barred.
You and we agree that all disputes, claims, or controversies arising out of or relating in any way to this agreement, (including the validity, enforceability or scope of this section and other sections of these Terms of Use), our site or any content or services thereon (each, a “Dispute”), that cannot be resolved through negotiation between you and us may be settled by final binding arbitration, in accordance with the terms of this section and to the extent permitted by law.
Arbitration means that the dispute will be resolved by a neutral arbitrator instead of in a court by a judge or jury. An arbitrator can award the same damages and relief on an individual basis that a court can award to an individual. Either party can initiate an arbitration proceeding.
You agree that any binding arbitration will occur in Halifax, Nova Scotia, Canada, and in accordance with the laws of Canada and the Province of Nova Scotia.
You agree that our liability and of any of our representatives, if any, arising out of any kind of legal claim or binding arbitration related to the use of our site will not exceed the amount you paid us for our educational resource(s).
The terms and conditions with respect to disputes shall survive any termination of your account with us.
Limitation of Liability
You agree to absolve and do hereby absolve Osteoforensics of any and all liability or loss that you or any person or entity associated with you may suffer or incur as a result of use of the Program and/or any information and resources contained in the Program. You agree that Osteoforensics shall not be liable to you for any type of damages, including direct, indirect, special, incidental, equitable, or consequential loss or damages for use of the Program.
The information, software, products, and service included or available through the Program may include inaccuracies or typographical errors. Changes are periodically added to the information in the Program. Osteoforensics may make improvements and/or changes in the Program at any time.
Osteoforensics makes no representations about the suitability, reliability, availability, timeliness, and accuracy of the information, software, products, services, and related graphics contained in the Program for any purpose. To the maximum extent permitted by applicable law, all such information, software, products, services, and related graphics are provided “as is” without warranty or condition of any kind. Osteoforensics hereby disclaims all warranties and conditions with regard to this information, software, products, services, and related graphics, including all implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement.
To the maximum extent permitted by applicable law, in no event shall Osteoforensics be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data, or profits arising out of or in any way connected with the use or performance of the Program, with the delay or inability to use the Program or related service, the provision of or failure to provide services, or for any information, software, products, services, and related graphics obtained through the Program, or otherwise arising out of the use of the Program, whether based on contract, tort, negligence, strict liability, or otherwise, even if Osteoforensics has been advised of the possibility of damages. Because some States or other jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitations may not apply to you. If you are dissatisfied with the Program or any portion of it, your sole and exclusive remedy is to discontinue using the Program.
Indemnification
You agree to indemnify, defend, and hold harmless Osteoforensics, its officers, directors, employees, agents, and third parties for any losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of or inability to use the Program and related services, any user postings made by you, your violation of any terms of this Agreement or your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations. Osteoforensics reserves the right, at its own cost, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will fully cooperate with Osteoforensics in asserting any available defenses.
Entire Agreement
This Agreement, along with Osteoforensics Terms of Use and Privacy Policy constitutes the entire agreement between you and Osteoforensics with respect to the Program, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Osteoforensics with respect to the Program. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
Severability
If any term or provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction.
Waiver
No waiver by any Party of any of the provisions of this Agreement shall be effective unless explicitly set forth in writing and signed by the Party so waiving. Except as otherwise set forth in this Agreement, no failure to exercise, or delay in exercising, any right, remedy, power, or privilege arising from this Agreement shall operate or be construed as a waiver thereof, nor shall any single or partial exercise of any right, remedy, power, or privilege hereunder preclude any other or further exercise thereof or the exercise of any other right, remedy, power, or privilege.
Force Majeure
Osteoforensics shall not be liable or responsible to you, nor be deemed to have defaulted or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of Osteoforensics including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion, or hostilities (whether war is declared or not), terrorist threats or acts, riot, or other civil unrest, national emergency, revolution, insurrection, epidemic, lock-outs, strikes or other labor disputes (whether or not relating to either party's workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
Effective Date
This Agreement shall commence and be enforceable with respect to each Program participant upon the date that the participant initially pays the full fee for the Program.
